Pembahagian Harta Pusaka Felda: Perspektif Masyarakat Islam Felda Taib Andak

Abstract

Commonly, it is well known that the distribution of the FELDA inheritance property has its own unique and different from usual because the distribution of the property is subject to the Land Act (Group Settlement Area) 1960. The objective of this article is to examine the issues of inheritance property distribution of Muslim community in Felda Taib Andak, Kulai Johor. In this study, the settlers have responded to authors about the mechanism of FELDA estate division and their views and attitudes. Besides that, the views of some of the individuals involved directly or indirectly that related to the FELDA property matter had taken out. Results showed that most of the settlers had chosen to appoint administrators as FELDA estate distribution mechanism than giving ownership directly to any of the heirs agreed to. The study also found that the attitude of the settlers in the settlement division of the community estate is the main cause for the occurrence of problems in FELDA inheritance property distribution. Based on the results of this study, the authors have some suggestions as a method of solution to the FELDA settler’s estate distribution issues.
