In modern islamic discourse, the maqÄá¹£id al-syarī’ah term is often said by muslems scholars nowadays. MaqÄá¹£id al-syarī’ah is a theory assumed by muslems scholars as one solution to solve crisis of tought in modern ijtihad of ushul fiqh. The term is actualy simply old which developed and wellknown by SyÄá¹ibi. The problem appear due to the term is not only popularised but also it has totally different with the initial meaning. This article investigates the theory of maqÄá¹£id according to SyÄá¹ibi, and to what extent the theory as a method for ijtihad ushul, and applicable to modern islamic society.
